    All Software material, information and content furnished by Ars Group Limited are protected by copyright and other applicable and relevant laws. You agree that you will not reproduce, modify, decompile, disassemble or derive the source code for the Software, publish any performance or benchmark test or analyses relating to the Software of the use thereof. You will have rights to use this Software under the condition that you do not change the materials or remove any copyright or other proprietary rights notices in the materials. You may not distribute or copy such material without the written permission of the copyright owner. By downloading the Software, you hereby understand and accept that while Ars Group Limited takes serious measures to prevent security issues, we do not guarantee the Software is free from viruses, errors or any contaminating or destructive codes, such as worms or Trojan horses.

    We may provide links to third party sites that may interest you. We do not have control over the content or availability of these said sites and are not responsible for any content in the said third party sites. It is your responsibility to read and understand each site’s privacy and other policies and terms and conditions of their service.   4. About Your Content
    You may upload your photobook designs to Ars Group Limited through arsPHOTO website or provide us with your file that meets our specifications and requirements necessary. Context of design includes without limitation, photographic images, texts, files, works of authorship, illustration and drawings as part of your use of the Service.

    Under these Terms of Service, you warrant that you will not use any of the services for any fraudulent or illegal purpose, and you may NOT place any of the following material using the Service:
    1. Any material that could infringe on the rights of publicity, privacy or copyrights without the approval and consent of the owner of these rights.
    2. Any material that could infringe any materials that is unlawful, obscene, pornographic, indecent, defamatory, offensive, abusive, threatening, or otherwise inappropriate and harmful to children in any way, or could give rise to any civil or criminal liability under applicable law.
    3. Any material that contains viruses, worms, corrupt files, Trojan horse or other sort of corrupted codes.
    4. Any material that is offensive or promote racism, bigotry or hatred against any group or individual.

    Ars Group Limited does not and cannot review all submissions, and is not responsible for their content, but reserves the right to move, refuse to print and delete submissions that, in its sole discretion, is believed to be as described in paragraphs (a) through (d) above, or otherwise unacceptable. You acknowledge and agree that any submission may be published, copied, customized or removed for the purposes of delivering the Services. In addition, you undertake that you will be liable for any action taken against Ars Group Limited in relation to such activities and will fully indemnify Ars Group Limited against all actions, claims, demands or costs which may arise as a result.

    We do not store your order information such as delivery, payment and billing data, and storage for uploaded files are optional. We recommend that before submitting files to us, you retain a copy for yourself to use for future re-ordering, or in the unlikely event of your digital images being corrupted or lost. You should always retain your own copies of all files uploaded or otherwise supplied to us. Ars Group Limited has no ownership in any of your product content.

  5. Account and Membership
    Ars Group Limited could terminate your membership at any time and for any reason, effective upon sending notice to you at the current e-mail address in your Account profile. The termination of your Account and Membership involves deletion of profile information from our live databases as well as any content that you uploaded to arsPHOTO using such Account. Ars Group Limited will not have any liability whatsoever to you for any termination of your Account or related deletion of your information.

    Registration
    When and if you set up your account and register to use the Service, you agree to provide accurate, current and complete information about yourself as promoted by our registration form (including your email address), and maintain and update your information (including your email address) to keep it accurate, current and complete. If any information provided is untrue, inaccurate, not current or incomplete, we reserve the right to terminate your access to and use of the Service. Our use and disclosure of any such information that you provide is governed by our Privacy Policy.

    Password
    When you sign up to become a member, you will also be asked to choose a username and a password. You are entirely responsible for maintaining the confidentiality of your password. You agree not to use the account, username, or password of another Member at any time. You agree to notify Ars Group Limited immediately if you suspect any unauthorized use of your Account or access to your password. You are solely responsible for any and all use of your Account.

    Profile
    Any Content posted by you in your profile may not contain nudity, violence, sexually explicit, or offensive subject matter. You may not post or submit for print services a photograph of another person without that person's permission.

    Miscellaneous
    You will not attempt to impersonate another User or person, including any employee of Ars Group Limited. You will use the Services in a manner consistent with any and all applicable laws and regulations.

    Third Parties and Other Users
    Content from other Users, advertisers, and other third parties is made available to you through the Services. Because Ars Group Limited does not control such Content, you agree that Ars Group Limited is not responsible for any such Content, including advertising and information about third party products or services. Because Ars Group Limited does not have control over such Content, Ars Group Limited makes no guarantees about the accuracy, currency, suitability, or quality of such Content, and Ars Group Limited assumes no responsibility for unintended, objectionable, inaccurate, misleading, or unlawful Content made available by other Users, advertisers, and third parties.

    Your interactions with other Users or third parties, or with advertisers, including payment and delivery of goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and the other User, the advertiser, or third party. The foregoing also applies to any interaction between Members (including the contribution and/or receipt of any Content) in the course of using the Services functionality to make contributions to the products of other Members and to receive contributions from other Members to your own Products. You agree that Ars Group Limited will not be responsible for any loss or damage incurred as the result of any such interactions and dealings listed in this section or with respect to any other User's use or disclosure of your personally identifiable information. If there is a dispute between you and any third party (including any User), Ars Group Limited is under no obligation to become involved; however, Ars Group Limited reserves the right to monitor disputes between you and other Users.

  6. Order
    Receipt of an electronic order or other form of order confirmation by no means signify Ars Group Limited’s acceptance of your order, nor does it constitute confirmation of our offer to sell. Ars Group Limited reserves the exclusive right at any time after receipt of your order, to accept or decline your order for any reason. Ars Group Limited also reserves the right at any time after receipt of your order and without prior notice to you, to supply less than the quantity you order for any time. Your order is deemed accepted by Ars Group Limited upon our delivery of products that you have ordered. We may require additional verifications or information before accepting any order.

    You agree to pay all fees and charges incurred in connection with your orders and purchases (including any taxes imposed on your orders and purchases, including, but not limited to, sales, use or value-added taxes, unless you provide Ars Group Limited with sufficient evidence that the order and purchase is made solely for the resale or redistribution of the Product or other product to your customers) at the rates in effect when the charges were incurred. Ars Group Limited may automatically charge and withhold such taxes for orders to be delivered to addresses within any jurisdictions that it deems is required.

  7. Voucher
    Ars Group Limited will regularly offer a variety of voucher that can be redeemed through arsPHOTO. You must have an Account with arsPHOTO to redeem these, redeeming voucher constitutes acceptance of the Ars Group Limited’s Terms and Conditions.

  8. Production
    We do NOT accept any amendments or changes to be made to the file ONCE the file (book) is uploaded.

    Content
    While Ars Group Limited does not review file submissions and is not responsible for the content, Ars Group Limited reserves the right to move, refuse to print and delete submissions that, in its sole discretion, are believed to be as described in Terms of Service, or otherwise unacceptable. You may be required to re-submit your file should there be any corrupted data or images in previously submitted book files.

    Image Quality
    Ars Group Limited does not review nor is responsible for editing images or book designs. Ars Group Limited is not responsible for the quality of your images.

    Ars Group Limited will investigate whether a defect is deemed a manufacturing issue or a customer generated choice/mistake. Regarding concerns with dark in contrast images, please remember that all computer monitors and LCD screens are calibrated differently. This means that each monitor will reproduce colours differently because the brightness and contrast adjustments are different on each individual computer monitor. Prior to adjusting or editing your images, ensure that the brightness and contrast settings on your computer monitor are at the lowest possible or according to your desired calibration and image output.

    Ars Group Limited reserves the right to refuse any refund, compensation or reprint/remake of book(s) in the incidences that (a) photographs/images/backgrounds/graphics appear dark in contrast but which are consistent with the properties of darkness/contrast levels of the original book file and (b) existing photographs/images/backgrounds/graphics are of low DPI resolution and aspects such as blurriness or pixilation which have compromised the quality of final product.

    We are NOT responsible for any customer-generated mistakes, errors or defects including spelling, typographical or grammar errors, poor image quality derived from low-resolution images, order quantity or other ordering errors. Your uploaded file/order will be treated as the final submission and production will commence on an immediate basis upon receiving your order. It is your responsibility to check and ensure that your file is free of errors.

    IMPORTANT: You are advised to check the quality and condition of all photographs/images/backgrounds/graphics prior to sending your order to print specifically if extensive editing is done such as and not limited to: resizing, zooming, cropping, and any such actions that risk reducing the overall resolution. Ars Group Limited reserves the right to decide whether to reprint or refund any book(s) and determines the final assessment of whether defects are due to customer generated mistakes.

    Book Condition
    Please note that each book is individually hand-made using Ars Group Limited's top-notch professional printing quality and binding methods. No two books can ever be duplicated exactly. Minor differences across different prints of the same book and/or across books printed including, but not limited to, slight variances in colour fidelity and binding type are not valid reasons for cancellations, reprints or refunds on book orders.

    We aim for the utmost in quality checks and assurance on all orders. In the unfortunate case that such issues arise like wrinkling or wavy pages or such defects related to the physical condition of your book order, please let us know. We'll investigate and handle your concerns with precedence.

    You are advised to alert us in cases of manufacturing errors, such as mistake in pagination order or physical condition of the book order. We shall assess the condition of the item(s), and at our sole discretion, we will decide to either repair or replace the product(s) that does not meet the warranty or condition.

    Material
    Ars Group Limited reserves the right to substitute/change materials used in production of your book without prior notice, including but not limited to paper, cover material, and end paper/sheets. In the case of material shortages, we will substitute by using the next best alternative of the closest quality and order specifications.

    If you order or reorder with us, and materials or book options happen to be different than advertised on our website due to unavailability or changes, this does not warrant the ability to request reprints, refunds or cancellations on orders.

  9. Fee and Payment Terms
    All prices are in their respective local currencies and payment must accompany each order. There is no charge for browsing or accessing the Site. Prices, products and services offered are subject to change without prior notice from time to time at our discretion upon posting by Ars Group Limited on its website(s).

    You hereby agree to pay all fees and charges incurred in connection with your orders which include without limitation postages, taxes, duty imports, value-added taxes and customs clearance, if any. Payment terms will be via online credit card transactions, or unless otherwise stated. We reserve the right to refer to your credit card provider. Ars Group Limited will not be held liable for any losses you may suffer as a result of unauthorized use of your credit card by any other party.

    An electronic sales order confirmation will be sent to your email address once your order has been captured into our system.Failure to submit a valid payment may result in refusal to process the requested service(s). In the case that an order with a paid deposit is processed, we will hold the order for 60 days, or unless otherwise stated. During this period and until the balance amount is paid in full, Ars Group Limited may send a notice to the customer's email address to inform of their balance due. If the balance due is not paid within the said period, Ars Group Limited may exercise its right to charge a handling fee and discard any unpaid property. Prices and specifications are subject to change without notice in any circumstances other than where an order has been accepted by us.

    In cases of disputes, you must alert Ars Group Limited by writing within 7 days after receiving your credit card statement, if you dispute any of our charges on that statement.

    If Ars Group Limited does not receive payment from your credit card issuer, you are obliged to pay all amounts due upon demand by Ars Group Limited. If you dispute any of our charges on that statement, or such dispute will be deemed waived. Billing disputes should be notified.If Ars Group Limited does not receive payment from your credit card issuer or its agent, you agree to pay all amounts due upon demand by Ars Group Limited or its agents.

  10. Delivery of Products
    All products or prints will be delivered to the delivery address supplied by you during the order process. Time for delivery is an estimate only and it is not a condition of this agreement. Delayed delivery is not a basis for cancellation of the order or a request for compensation. Orders may be refused if we believe that there is any infringement to this Terms of Service, and entirely at the discretion of Ars Group Limited.

    Ars Group Limited works closely with reputable and reliable courier partners. Orders will be delivered to the given address provided by customers during the order/checkout process. Ars Group Limited reserves the right to change shipping agents without prior notice. Delivery and production time may vary during peak and holiday seasons and is also dependent on your order and quantity. With that said, please keep in mind that we cannot control the time lines and shipment schedules of our delivery providers or services, especially during holidays. Delayed delivery is not a basis for cancellation of the order or a request for compensation.

    Delay or failure to submit a valid payment or complete book file may result in refusal to process and/or delay in production/delivery. Ars Group Limited will not be liable for delay in delivery caused by but not limited to late file submission, corrupted files, delayed payment, or incorrect address. Orders may be refused if there is any infringement to Terms of Service, and entirely at the discretion of Ars Group Limited.

    When you order Products or other products for overseas delivery, you may be subject to import duties and taxes, which are levied when the package with the Products or products arrives at the destination that you specified. Any charges for customs clearance have to be borne by you, as Ars Group Limited has no control over such charges and cannot foresee the amount charged (if any).

  11. Force Majeure
    A party will not be liable for non-performance or delay in performance caused by any extraordinary event or circumstance beyond the control of such party including, without limitation, wars, strikes, riots, hostilities, revolutions, national emergency, explosion, civil commotion, embargo, fire, flood, earthquake, volcanic eruption, and force of nature or any “acts of God”.

  12. Satisfaction Guarantee & Return Policy
    Ars Group Limited is proud of the outstanding quality and craftsmanship of our products, and provides 100% Satisfaction Guarantee against any manufacturing defects. Refunds and cancellation of order is generally not provided except for cases of process or product malfunction (i.e. workmanship defect, product do not match ordered items), Ars Group Limited would re-do the product to customers.

    To file a complaint, kindly contact our customer services by writing to us together with photos of problem/areas of dissatisfaction. We will assess the condition of the item(s), and at our sole discretion to either repair or replace the product(s) that does not meet the warranty or condition. All defective products must be returned to us within 7 days of receipt upon request.

  13. Electronic communications
    The communications between you and Ars Group Limited use electronic means, whether you visit the Website or send Ars Group Limited e-mails, or whether Ars Group Limited posts notices on the Website or communicates with you via e-mail. For contractual purposes, you (a) consent to receive communications from Ars Group Limited in an electronic form; and (b) agree that all terms and conditions, agreements, notices, disclosures, and other communications that Ars Group Limited provides to you electronically satisfy any legal requirement that such communications would satisfy if it were be in writing. The foregoing does not affect your statutory rights.
